This Return / Refund Policy applies to consumer purchases made through www.theoneshirt.de. TheOneShirt is a brand operated by AMTHENO OÜ, which is the seller and contractual party. This Policy does not limit any mandatory consumer rights under applicable Estonian, EU or other applicable consumer law.
TheOneShirt garments are produced only after a confirmed order and are permanently personalised with the customer's mandatory individual monogram. Depending on the product, customers may also choose standard options such as fit, size, pocket style and hem style.
The fact that a garment is made to order, that no finished-garment stock is held, or that the customer chooses from ordinary standard options does not by itself remove a statutory withdrawal right. The relevant personalisation for current TheOneShirt garments is the customer's individual permanent monogram.
Consumers who conclude a distance contract normally have a statutory 14-day right of withdrawal, subject to legal conditions and exceptions. That statutory withdrawal right does not apply to goods made to the consumer's specifications or clearly personalised.
Because current TheOneShirt garments are permanently personalised with the customer's individual monogram, the statutory change-of-mind withdrawal right does not apply to those personalised garments. Before the order is completed, the customer is informed of this and must actively confirm the relevant acknowledgement in the ordering process.
This exclusion concerns change-of-mind withdrawal only. It does not affect the customer's statutory rights if a garment is defective, damaged, incorrectly produced or otherwise does not conform to the order.
As an additional customer service, AMTHENO OÜ normally allows the customer to request a change to, or cancellation of, an order within 24 hours after payment, provided production has not yet begun. Requests should be sent promptly to dany@annamorgantailoring.com.
This voluntary 24-hour window is separate from the statutory right of withdrawal and does not create a statutory withdrawal right for a personalised garment. AMTHENO OÜ will confirm whether a requested change or cancellation can still be accepted.
AMTHENO OÜ is responsible for delivering goods that conform to the contract. If a TheOneShirt garment is defective, damaged, incorrectly produced or otherwise does not conform to the confirmed order, the customer should contact us and provide the order number, a clear description of the issue and clear photographs. Where reasonably necessary, we may also request video or other information that helps us assess the problem.
Customers should notify us as soon as reasonably possible after discovering a problem. For visible delivery damage or obvious issues, we encourage contact preferably within 7 days so the matter can be documented quickly. This 7-day request is not a statutory deadline and does not shorten the customer's mandatory rights.
Under Estonian consumer-sale rules, the seller is generally liable for a lack of conformity that becomes apparent within two years after delivery. A lack of conformity that becomes apparent within one year after delivery is presumed to have existed at the time of delivery unless that presumption is incompatible with the nature of the item or defect. A consumer should notify the seller of a lack of conformity within two months after becoming aware of it.
Because TheOneShirt garments are individually produced and permanently personalised, they cannot normally be resold. AMTHENO OÜ therefore does not normally require a defective personalised garment to be physically returned solely for inspection. In most cases, we will first assess the claim using the order information, photographs and, where reasonably requested, video or other supporting information.
If AMTHENO OÜ determines that a physical return is reasonably necessary to assess or resolve a conformity claim, we will provide the customer with specific return instructions. Where applicable law requires AMTHENO OÜ to bear the cost of that return, the reasonable return cost will be borne by AMTHENO OÜ. Customers should not send a garment to the registered office or any former return address unless AMTHENO OÜ has specifically instructed them to do so.
Where a garment does not conform to the contract, the customer may be entitled to the remedies provided by mandatory law. Depending on the circumstances, this may include repair or replacement and, where the legal conditions are met, a proportionate price reduction or termination of the contract/refund.
For a personalised made-to-order garment, a repair or replacement/remake will often be the most practical remedy where it can restore conformity without disproportionate cost or inconvenience. If a replacement is appropriate but the original fabric is no longer available, we will contact the customer to agree an appropriate legally compliant solution. A replacement is not the customer's only possible statutory remedy where mandatory law provides otherwise.
AMTHENO OÜ may reasonably require the customer's cooperation and sufficient information to assess and, where appropriate, reproduce the garment. A failure to provide information that is genuinely necessary to assess or carry out the remedy may delay resolution, but nothing in this Policy removes rights that cannot lawfully be excluded.
A refund is not offered merely because a customer changes their mind about a personalised garment. A refund may, however, be required where a garment does not conform to the contract and the legal conditions for termination/refund are met, or in another situation where applicable mandatory law requires a refund.
Where a refund is legally due, it will be made using the original payment method where reasonably possible, unless another method is agreed with the customer and permitted by law.
If a parcel arrives visibly damaged, an item is missing or there is another delivery problem, please contact us as soon as reasonably possible with the order number and clear photographs where relevant. Prompt reporting helps us investigate the matter with the logistics provider but does not shorten mandatory statutory rights.
If TheOneShirt later sells a product that is not made to the consumer's specifications and is not clearly personalised, any statutory withdrawal right applicable to that product will remain available. For any product to which a statutory right of withdrawal applies, AMTHENO OÜ will provide the electronic withdrawal function required by applicable Estonian law, including electronic submission and confirmation of receipt.
Complaints may be sent to dany@annamorgantailoring.com. Please include the order number and enough information for us to understand and assess the issue. AMTHENO OÜ will provide a written response within the period required by applicable Estonian consumer law.
Where a consumer and AMTHENO OÜ cannot resolve a dispute directly, an eligible consumer may apply to the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon) under the Consumer Protection and Technical Regulatory Authority (TTJA), subject to its jurisdiction and procedural requirements. Other remedies available under applicable law remain unaffected.
